1. Subject of the Agreement
This User Agreement (hereinafter referred to as the Agreement) on the rights to use the web portal of the state property register e-qazyna.kz (hereinafter referred to as the Portal) is an adhesion contract in accordance with Article 389 of the Civil Code of the Republic of Kazakhstan and is intended to regulate the relations between the joint-stock company “Information and Accounting Center,” with 100% state participation in the authorized capital, designated in accordance with Resolution of the Government of the Republic of Kazakhstan dated July 15, 2011 No. 802 as the single operator in the field of state property accounting (hereinafter referred to as the Operator), and the Portal User (hereinafter referred to as the User), hereinafter jointly referred to as the “Parties.”
The User is any individual or legal entity registered on the Portal and using its services and/or the services of the Operator.
This Agreement constitutes a public offer. By accessing the Portal and its information services (hereinafter referred to as the services), the User shall be deemed to have acceded to and accepted all terms of this Agreement.
2. General Provisions
2.1. The Portal is a single point of access for obtaining information and interactive services of the Operator, in particular, those related to the state property register.
2.2. Registration on the Portal and its use shall be carried out subject to the User’s acceptance of and compliance with the terms of this Agreement. By visiting the Portal and using its services, the User thereby agrees to the terms and provisions of this Agreement. Registration on the Portal is free of charge and voluntary.
2.3. The terms of the Agreement shall apply even if access to the Portal is carried out outside the Republic of Kazakhstan, as well as if access is provided via a link leading to the opening of the Portal. The Portal is administered by the Operator, who is authorized, among other things, to post and exchange information on the Portal.
2.4. This Agreement may be amended by the Operator without any special notice.
2.5. If the User disagrees with the amendments made, the User shall have the right to refuse access to the Portal and its services and to cease using the Portal and its services.
2.6. By signing this Agreement, the User thereby gives written consent to the issuance of a credit report from a credit bureau, as well as to the collection, processing, storage, uploading, and use of their personal data and other information submitted by them on the Portal.
3. Rights and Obligations of the Parties
3.1. The Operator shall have the right to:
3.1.1. if necessary, verify the accuracy of the data entered by the User, including by contacting state authorities and other organizations;
3.1.2. in the event of the User’s violation of the terms of this Agreement, refuse the User’s registration, delete or block the User’s account;
3.1.3. terminate the User’s access to the Portal on the grounds provided for in subparagraphs 4.6, 4.7, and 4.8 of paragraph 4 of this Agreement;
3.1.4. send informational notifications to the User in the form of SMS messages and/or PUSH notifications;
3.1.5. receive, as the User’s trusted representative, a security token for obtaining their personal data (information constituting a commercial secret), including through the use of state and non-state personal data access control services.
3.2. The User shall have the right to:
3.2.1. receive advisory and practical assistance from the Operator regarding the use of the Portal;
3.2.2. top up the balance of their personal account on the Portal to pay for services/functions.
3.3. The Operator shall be obliged to:
3.3.1. ensure the functioning of the Portal and its services;
3.3.2. not disclose personal information about the User (personal data), except in cases provided for by the legislation of the Republic of Kazakhstan.
3.4. The User shall be obliged to:
3.4.1. in order to receive the Portal’s services and functions:
1) have an IIN (for individuals) or BIN (for legal entities);
2) at the time of registration, have a valid electronic digital signature (hereinafter referred to as the EDS) issued by the National Certification Center of the Republic of Kazakhstan;
3) complete the registration procedure;
3.4.2. provide the Operator with accurate and complete information on the items set out in the registration form on the Portal or when using its services;
3.4.3. not take actions that may be regarded as violating the legislation of the Republic of Kazakhstan or the norms of international law, including in the field of intellectual property, copyright and/or related rights, as well as any actions that result or may result in disruption of the normal operation of the Portal and its services;
3.4.4. ensure that comments and other entries made by the User on the Portal and its services do not contradict the requirements of the legislation of the Republic of Kazakhstan and generally accepted standards of morality and ethics;
3.4.5. when using the Portal, not impersonate another person, not use materials containing viruses or other malicious software, not record access passwords on information carriers, not transfer received access identifiers to third parties, and use their own EDS;
3.4.6. not use the Portal and the information obtained on the Portal for the purposes of terrorism, extremism, incitement of interethnic hatred, and for other purposes prohibited by the legislation of the Republic of Kazakhstan;
3.4.7. sign, using the EDS, applications and/or other documents necessary for carrying out transfer operations through the Portal (execution of payment and money transfer orders of individuals and legal entities) and serving as confirmation of the fact of payment.
4. Liability of the Parties
4.1. In the event of a violation of the terms of this Agreement resulting in damage to all or one of the Parties to the Agreement, the Party at fault shall bear liability in accordance with the legislation of the Republic of Kazakhstan.
4.2. The Operator shall not be liable for temporary technical failures and interruptions in the operation of the Portal and its services arising for reasons beyond the Operator’s control or in the event of scheduled or unscheduled maintenance of the Portal and its services.
4.3. The Operator shall not be liable for temporary failures and interruptions in the operation of communication lines, other similar failures, as well as for malfunctions of the computer or mobile communication device from which the User accesses the Portal and its services.
4.4. The Operator shall not be liable to the User for the actions of other Users and any other participants of the Portal and its services.
4.5. The Operator shall not be liable for any direct or indirect damage, including lost profit, loss of use, data loss, or any other intangible losses, reputational damage, and other damage arising as a result of:
1) use or inability to use the Portal and its services by Users;
2) changes to the terms of the Agreement made by the Operator.
4.6. The User shall bear full responsibility for the accuracy of the data provided during registration on the Portal, as well as for untimely updating and correction of data in the course of using the Portal.
4.7. The User shall bear full responsibility for non-performance or improper performance of their obligations under other agreements concluded with the Operator. In the event of such violations (non-performance or improper performance of their obligations under other agreements concluded with the Operator), the Operator shall have the right to terminate the User’s access to the Portal.
4.8. The User assumes all risks and possible damage arising as a result of providing inaccurate information about themselves, as well as from transferring their own data and EDS to third parties, related to registration on the Portal and the use of its services.
5. Miscellaneous
5.1. The Portal and/or the Operator reserve the right to provide additional paid services to the User, which shall be governed by other agreements.
5.2. This Agreement shall enter into force from the moment of the User’s registration on the Portal and shall remain in effect for three years.
Upon expiration of the three-year period, this Agreement shall be concluded for a new term.
