1. Subject of the Agreement

This User Agreement (hereinafter referred to as the Agreement) on the rights use of the web portal of the register of state property e-qazyna.kz (hereinafter referred to as the Portal) is an accession agreement in accordance with article 389 of the Civil Code of the Republic of Kazakhstan and is intended for settlement of relations between the joint-stock company "Information and accounting center", with 100% participation of the state in the statutory capital determined in accordance with the Government Decree of the Republic of Kazakhstan dated July 15, 2011 No. 802 as a single operator in the field accounting of state property (hereinafter referred to as the Operator), and the User of the Portal (hereinafter referred to as the User), hereinafter collectively referred to as the "Parties".

The user is any natural or legal person, registered on the Portal and using its services and/or Operator.

This Agreement is a public offer. By accessing the Portal and its information services (hereinafter referred to as services), the User is considered acceded to and accepted all the terms of this Agreement.

2. General provisions

2.1. The portal is a single access point for receiving information and interactive services of the Operator, in particular, those related to the registry state property.

2.2. Registration on the Portal and its use are subject to acceptance and compliance by the User with the terms of this Agreement. visiting The Portal and using its services, the User hereby agrees to the terms and conditions of this Agreement. Registration on the Portal is free and voluntary.

2.3. The terms of the Agreement apply even if access to The portal is carried out outside the Republic of Kazakhstan, and also, if Access is via a link that leads to the opening of the Portal. Administration of the Portal is carried out by the Operator authorized to including posting and exchanging information on the Portal.

2.4. This Agreement may be amended by the Operator without any special notice.

2.5. If the User does not agree with the changes made, he has the right refuse access to the Portal and its services and stop using Portal and its services.

2.6. By signing this Agreement, the User hereby gives written consent to issue a credit report from a credit bureau, and to collect, process, store, upload and use his personal data and other information provided by him on the Portal.

3. Rights and obligations of the Parties

3.1. The operator has the right:

3.1.1. if necessary, check the accuracy of the entered data User, including by contacting government agencies and other organizations;

3.1.2. in case of violation by the User of the terms of this Agreement refuse to register the User, delete or block the account User;

3.1.3. stop providing access to the User to the Portal by the grounds provided for in subparagraphs 4.6, 4.7 and 4.8 of paragraph 4 of this Agreements;

3.1.4. send informational notifications to the User in format of SMS messages and/or PUSH notifications;

3.1.5. receive a security token as a proxy of the User to obtain his personal data (information constituting a commercial secret), including with the use of State and non-state access control services to personal data.

3.2. The user has the right:

3.2.1. receive consulting and practical assistance from the Operator, in parts of using the Portal;

3.2.2. replenish the balance of your personal account on the Portal for payment services/services.

3.3. The operator is obliged:

3.3.1. ensure the functioning of the Portal and its services;

3.3.2. not to distribute personal information about the User (personal data), with the exception of cases provided for by law Republic of Kazakhstan.

3.4. The user is obliged:

3.4.1. to receive the services of the Portal and its services:

1) have an IIN (for individuals) or a BIN (for legal entities);

2) at the time of registration, have a valid electronic digital signature (hereinafter referred to as the EDS), issued by the National Certification Center of the Republic Kazakhstan;

3) go through the registration procedure;

3.4.2. provide the Operator with accurate and complete information on the points, offered in the registration form on the Portal or when using it services;

3.4.3. not take any action that could be considered violating the legislation of the Republic of Kazakhstan or the norms of international rights, including in the field of intellectual property, copyright and/or related rights, as well as any action that leads or may lead to violation of the normal operation of the Portal and its services;

3.4.4. avoid contradictions in the comments and other entries of the User on the Portal and its services to the requirements of the legislation of the Republic of Kazakhstan and generally accepted norms of morality and ethics;

3.4.5. when working on the Portal, do not impersonate another person, do not use materials that contain viruses or other harmful software, do not write access passwords on media information, do not transfer the received access identifiers to third parties, use your own EDS;

3.4.6. not to use the Portal and the information received on the Portal for the purpose of terrorism, extremism, inciting ethnic hatred and other purposes prohibited by the legislation of the Republic of Kazakhstan.

4. Responsibility of the Parties

4.1. In case of violation of the terms of this Agreement, resulting in causing harm to all or one of the Parties to the Agreement, the guilty Party bears responsibility in accordance with the legislation of the Republic Kazakhstan.

4.2. The operator is not responsible for technical temporary failures and interruptions in the operation of the Portal and its services that have arisen due to Operator's reasons or in case of scheduled or unscheduled maintenance activities of the Portal and its services.

4.3. The operator is not responsible for temporary failures and interruptions in operation of communication lines, other similar failures, as well as for computer problems, mobile communication device from which the User accesses Portal and its services.

4.4. The Operator is not responsible to the User for the actions other Users and any other participants of the Portal and its services.

4.5. The operator is not responsible for any direct, indirect damage, including lost profits, loss of use, loss of data or any other intangible loss, damage to reputation and other damage, resulting from:

1) use or inability to use the Portal and its services Users;

2) changes in the terms of the Agreement by the Operator.

4.6. The user is solely responsible for the accuracy provided data when registering on the Portal, as well as for untimely updating and correction of data in the process of use Portal.

4.7. The user is solely responsible for failure or improper performance of its obligations under other agreements concluded with Operator. In the event of such violations (non-performance or improper performance of its obligations under other agreements concluded with Operator), the Operator has the right to stop providing the User with access to the Portal.

4.8. The user assumes all risks and possible damage arising from as a result of providing them with false information about themselves, as well as for transfer of own data and digital signature to third parties related to registration on the Portal and using its services.

5. Other

5.1. The Portal and/or the Operator reserve the right to provide additional services to the User on a paid basis, which will be governed by other agreements.

5.2. This Agreement shall enter into force upon registration User on the Portal and is valid for three years.

After three years, this Agreement is concluded for a new term.
